1. Agreement to Terms
By accessing and using HirePilot (the "Service"), including any content, functionality, and services offered on or through HirePilot (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to abide by these Terms, you are not authorized to use the Platform. These Terms constitute the entire agreement between you and HirePilot regarding your use of the Platform.
2. License & Permitted Use
Subject to your compliance with these Terms, HirePilot grants you a limited, non-exclusive, revocable license to access and use the Platform for your personal, non-commercial job search activities. You may not:
- Reproduce, duplicate, or copy content or functionality from the Platform without express written permission.
- Attempt to gain unauthorized access to the Platform, its systems, or accounts.
- Engage in any form of harassment, abuse, or threats toward other users or HirePilot personnel.
- Use automated tools (bots, scrapers, crawlers) to access or interact with the Platform without prior written consent.
- Reverse engineer, disassemble, or attempt to derive the source code or algorithms powering HirePilot's AI.
- Transmit malware, viruses, worms, or any malicious code.
- Use the Platform for unlawful purposes or to solicit, promote, or encourage illegal activity.
3. User Accounts & Credentials
To access certain features of the Platform, you must create a user account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your password and account credentials. You agree not to share your login credentials with others.
You are solely responsible for all activities that occur under your account, whether or not you authorized them. You agree to immediately notify HirePilot of any unauthorized use of your account or any other breach of security.
4. Intellectual Property Rights
All content, features, and functionality on the Platform — including but not limited to text, graphics, logos, button icons, images, software, and algorithms — are owned by HirePilot or its content suppliers and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
Your use of the Platform does not grant you ownership of any intellectual property in the Platform or the content accessed through it. You retain all rights to any content you upload or provide to the Platform (resumes, cover letters, etc.), and you grant HirePilot a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and analyze that content for service improvement and AI model training.
5. User-Generated Content & Acceptable Use
When you upload or submit content to HirePilot (resumes, cover letters, interview recordings, coaching conversations, feedback), you represent and warrant that:
- You own or have obtained all necessary rights to the content.
- The content does not violate any third-party intellectual property, privacy, or other rights.
- The content is not defamatory, obscene, threatening, or otherwise inappropriate.
- You have disclosed any personal information of third parties contained in your content (e.g., references, employer names).
HirePilot reserves the right to remove any content that violates these Terms or applicable law. Repeated violations may result in account termination.
6. Subscription Plans & Billing
HirePilot offers various subscription plans with different features, pricing, and billing cycles. By subscribing to a paid plan, you agree to pay the stated fees according to the billing schedule you select.
- Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
- Payment Methods: You authorize HirePilot to charge your selected payment method (credit card, debit card, digital wallet) for all fees and charges.
- Price Changes: HirePilot may change subscription prices with 30 days' notice. If you do not cancel, you agree to the new pricing.
- Refunds: Subscription fees are generally non-refundable. However, if you cancel within 14 days of initial purchase, you may be eligible for a full refund. See our refund policy for details.
7. Warranties & Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. HirePilot disclaims all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Warranties regarding the accuracy, completeness, or usefulness of AI-generated recommendations.
- Warranties that the Platform will be uninterrupted, error-free, or secure.
- Warranties that the Platform will result in job offers, increased salary, or career advancement.
HirePilot is not responsible for any unsuccessful job applications, failed interviews, or employment outcomes. The recommendations provided are suggestions only and do not guarantee results.
8. Limitation of Liability
In no event shall HirePilot, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for lost profits, lost data, lost opportunities, or business interruption, arising out of or in connection with your use or inability to use the Platform, even if HirePilot has been advised of the possibility of such damages.
In no case shall HirePilot's total liability exceed the fees you paid to HirePilot in the 12 months preceding the claim, or $100, whichever is greater.
9. Third-Party Links & Services
The Platform may contain links to third-party websites, applications, and services not operated by HirePilot. These links are provided for your convenience only. HirePilot does not endorse and is not responsible for the content, accuracy, privacy practices, or availability of third-party services.
Your use of third-party services is governed by their terms of service and privacy policies. We recommend reviewing them before providing personal information.
10. Indemnification
You agree to indemnify, defend, and hold harmless HirePilot and its officers, directors, employees, agents, and successors from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your violation of these Terms.
- Your use of the Platform in violation of applicable law.
- Your user-generated content or communications with other users.
- Your infringement of any third-party intellectual property or privacy rights.
11. Termination of Service
HirePilot reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice, particularly if you violate these Terms. Upon termination:
- Your access to the Platform will be immediately revoked.
- Your subscription fees are non-refundable unless required by law.
- You remain liable for any outstanding fees or charges.
- Provisions that should survive termination (limitations of liability, indemnification, intellectual property rights) shall continue in effect.
12. Modification of Terms
HirePilot may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date above. Your continued use of the Platform after such notification constitutes your acceptance of the modified Terms.
If you do not agree to any modification, your only recourse is to discontinue use of the Platform.
13. Governing Law & Jurisdiction
These Terms and your use of the Platform are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco, California, for resolution of any dispute.
14. Dispute Resolution & Arbitration
Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting HirePilot at legal@hirepilot.com. If informal resolution fails, you agree to binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in San Francisco, California.
The arbitration shall be conducted under JAMS rules, with each party bearing its own costs unless the arbitrator awards fees to the prevailing party. By agreeing to arbitration, you waive your right to a jury trial and class action participation.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
